Rush No More RV Park & Cabins, is the DBA of ECM Parks and Recreation, Inc., a privately-owned South Dakota corporation authorized to do business in the State of South Dakota (together,”RNM”) You and all those in your party, including any guests (collectively, “You”) know and acknowledge that camping has inherent risks associated with outside activities and that RNM welcomes dogs and other domesticated animals, which may offer additional risk, and You accept and assume those risks, both known and` unknown. RNM is not responsible for injuries or damages occurring as part of the inherent risks of its special camping environment.

In consideration for camping at RNM and other good and valuable consideration, the sufficiency of which is hereby acknowledged, to the fullest extent allowed by law, You hereby release RNM, its officers, directors, employees and volunteers (“Indemnified Parties”) of all liability, except in the instance of their gross negligence or willful misconduct, for the loss or damages to property and injury to You or your pets arising out of the use of RNM, including but not limited to the camping facilities, and activities or events sponsored by RNM and agree to indemnify the Indemnified Parties against claims resulting from loss or damage to property or injury to You, including pets, arising out of the use of RNM, including but not limited to the camping facilities and any activities or events sponsored by RNM, unless caused by the Indemnified Parties’ gross negligence or willful misconduct.

You agree to pay for any damages to RNM’ property that You, other people in your party or your pets may cause. You agree to immediately report any accident, injury or property damage to management. If a hazard or dangerous situation is noticed, You agree to notify the management immediately. You also agree to take full responsibility for yourself and all those in your party, including pets and guests, and will require them to comply with all RNM rules and abide by and be bound by the terms of this Release, Indemnification and Consent.

You grant RNM the right to take your (including everyone in your party, pets and guests) photo or other image while at RNM. You authorize RNM to copyright, use and publish the same in print and/or electronically. You agree that RNM may use such photos or other images with or without your names and for any lawful purpose, including for example such purposes as publicity, illustration, advertising and Web content.

The laws of the State of South Dakota control this Release, Indemnification and Consent (“Agreement”). If any provision is found invalid, the remainder of this Agreement shall remain
enforceable.

I confirm that everyone in my party has read this Agreement as posted on the RNM website at:

and that they consent to its terms and I have received authority from everyone in my party to sign this Agreement on their behalf.

 

BY SIGNING YOUR REGISTRATION PAPERWORK AT ARRIVAL, YOU, ON BEHALF OF YOURSELF AND ALL MEMBERS OF YOUR PARTY, HAVE READ AND AGREE TO COMPLY WITH ALL RULES LISTED IN THE REGISTRATION FORM, POSTED IN THE OFFICE OR ON THE GROUNDS, ON THE RNM WEBSITE, OR OTHERWISE STATED BY MANAGEMENT AND BIND YOURSELF AND THOSE IN YOUR PARTY, HEIRS AND ASSIGNS TO THE TERMS OF THIS RELEASE, INDEMNIFICATION AND CONSENT.
